Declarations
This Agreement is entered into between Courtney Ross, Certified Functional Medicine Practitioner, Personal Trainer, and Health Coach (“Provider”), and the undersigned individual (“Client”).
Client understands that Provider offers services including, but not limited to, functional medicine support, wellness education, health coaching, nutrition guidance, lifestyle coaching, supplement education, personalized fitness training, corporate wellness programs, workshops, presentations, and lunch-and-learn events (collectively, “Services”).
Participation in any Services, whether provided in person, virtually, individually, or in a group or corporate setting, is conditioned upon acceptance of this Agreement.
Nature of Services & Medical Disclaimer
Client understands and agrees that all Services provided by Provider are educational and wellness-based in nature and are not medical care. Provider does not diagnose, treat, cure, or prevent disease, and Services are not a substitute for medical advice, diagnosis, or treatment from a licensed physician or other qualified healthcare professional.
Any information provided regarding functional medicine concepts, nutrition, supplementation, fitness, lifestyle habits, stress management, or wellness strategies is general in nature and intended for educational purposes only.
Client is solely responsible for consulting with a licensed healthcare provider regarding any medical conditions, medications, supplements, or changes to diet, exercise, or lifestyle.
Assumption of Risk
Client acknowledges that participation in the Services involves inherent and foreseeable risks, including but not limited to physical injury, illness, allergic reactions, adverse responses, emotional discomfort, or other health complications.
Client voluntarily assumes all risks, known and unknown, associated with:
Functional medicine education and wellness recommendations
Nutrition and dietary guidance
Supplement education, reviews, or recommendations
Lifestyle coaching and behavior changes
Personalized or group fitness training
Corporate wellness programs, workshops, and presentations
Lunch-and-learn sessions and educational events
Verbal guidance, written materials, digital resources, handouts, or demonstrations
Client understands that individual responses vary and that no outcomes or results are guaranteed.
Release of Liability
Client hereby releases, waives, and forever discharges Provider and any affiliates, employees, contractors, representatives, corporate partners, hosting organizations, successors, and assigns from any and all claims, demands, damages, injuries, losses, or causes of action arising out of or related to participation in the Services.
This release includes, without limitation, claims related to:
Functional medicine or wellness guidance
Nutrition, supplementation, or lifestyle recommendations
Exercise instruction or fitness programming
Educational content delivered in workshops, presentations, or corporate settings
Any statements, suggestions, opinions, or materials provided verbally or in writing
This release applies to claims arising from ordinary negligence and does not apply to gross negligence or intentional misconduct, to the extent prohibited by law.
Supplement Disclaimer
Client understands that supplements are not regulated in the same manner as prescription medications and that Provider does not manufacture, sell, or distribute supplements. Any supplement information provided is educational only, and Client assumes full responsibility for the use or non-use of any supplements.
Indemnification
Client agrees to indemnify, defend, and hold harmless Provider from any loss, liability, damage, or expense, including reasonable attorney’s fees, arising out of Client’s participation in the Services or reliance on information provided.
Corporate & Group Program Acknowledgment
Client acknowledges that participation in corporate wellness programs, workshops, lunch-and-learn sessions, or group events does not create an individualized provider-client or medical relationship. Information shared in these settings is general in nature and not tailored medical advice.
Acknowledgments & Severability
Client agrees that this Agreement is intended to be as broad and inclusive as permitted under the laws of the State of Ohio. If any portion is deemed unenforceable, the remaining provisions shall continue in full force and effect.
Consent & Electronic Acceptance
Client affirms that they have carefully read and fully understand this Agreement. Client acknowledges that by signing electronically, checking an acknowledgment box, registering for services, or participating in any Services, they are waiving legal rights, including the right to bring claims against Provider for ordinary negligence.
No oral representations or statements have been made outside of this written Agreement.
